"The Australian Competition and Consumer Commission has expanded its investigation into cargo price-fixing and yesterday announced commencement of legal proceedings against Air France, KLM, Martinair and Cargolux Airlines International for colluding on fuel surcharges between 2003 and 2006.
The carriers "made a number of admissions and consented to the remedies sought including penalties, injunctions and costs," ACCC said. Air France and KLM have offered to pay a combined fine of A$6 million ($4 million), while Cargolux and Martinair have offered A$5 million each. The Federal Court will determine the final penalties and a hearing is scheduled for Feb. 16.
"Cargolux has cooperated intensively with the ACCC and the other authorities throughout the investigation and the legal proceedings and will continue to do so," Chairman Marc Hoffmann said. The other airlines did not release statements."
